Warranty

PRICES:

Unless otherwise noted, all prices are installed, state sales tax included where applicable.  Prices based on installation requiring labor as estimated.  Additional trips will be charged at current published rates.

EXECUTION OF WORK:

Installations and deliveries shall at all times be subject to the approval of J.B. Mathews Company’s credit department.

DELIVERY OF ORDERS:

J.B. Mathews Company shall be under no liability for failure to make deliveries for causes beyond its control, such as but not limited to, government priorities, allocation of materials, fires, work stoppage or slowdown, acts of God or public enemy, or transportation difficulties.  Under no circumstances will J.B. Mathews Company assume responsibility for any damage growing out of or owing to, any delay of any kind whatsoever, unless there is an agreement to the contrary in writing between J.B. Mathews Company and the buyer.

CHANGES TO OR CANCELLATION OF ORDERS:

When the buyer requests changes to or cancellation of an order, the following policy will apply:

1.   Changes to or cancellation of an order may be made at no cost to the contractor until such time that costs have been incurred beyond that of normal processing.  Approval drawings and materials ordered or fabricated are examples of such costs.  Once cost has been incurred by J.B. Mathews Company, the right to recover these costs is reserved by J.B. Mathews Company.

2.   Changes that require labor will be charges at J.B. Mathews Company’s standard hourly rate plus 25% overhead cost and 15% profit mark-up.

COLLECTION:

All accounts are delinquent after forty-five (45) days of invoice.  Should it become necessary to place this account in collection, suit or other legal proceeding, the undersigned agrees to pay all costs and expenses of collection, suit or legal proceeding, including reasonable attorney fees and, if necessary, appellate fees.

The undersigned hereby waives any and all privileges and rights which they may have under Chapter 47, Florida Statutes, relating to venue, as it now exists, or may hereafter be amended; and further, the undersigned agrees that any legal action brought for collection of past due accounts may be brought in the appropriate court in Orange County, Florida.

J.B. Mathews Company will assess a $40.00 fee for any returned checks.  It is J.B. Mathews Company’s standard policy to file a notice to buyer and should it become necessary, we reserve the right to file a lien.

WARRANTY:

material: j.b. Mathews Company is proud of a long tradition of industry leading customer service and quality workmanship. We warrant every product we sell for one (1) year from the date of installation and or delivery; or per the manufacturer’s warranty.  labor: J.B. Mathews Company will only warrant labor for 30 days or per the manufacturer’s warranty. J.B. Mathews Company does not warrant damage due to neglect, misuse or lack of manufacturer’s recommended maintenance.  Work or maintenance provided by any other than J.B. Mathews company during the warranty period voids the warranty. J.B. Mathews company offers an extended 5 year warranty plan on selected products and maintenance programs according to manufacturer’s recommendations at an affordable additional price.

A signed proposal or standard AIA contract agreement must be executed by J.B. Mathews Company and the buyer prior to proceeding with any fabrication of materials.  A complete job site address and/or directions to the job site and tentative date of installation are also required.  Should materials be fabricated and shipped according to a construction schedule and installation be delayed, J.B. Mathews Company reserves the right to partial bill for materials only.
